A Mem’l of an Indented Deed bearing Date the Second day of May one thousand seven hundred and seventy five and Made Between Jn’o 3 Ferguson Eldest Son and Heir of David Ferguson Late of Faratar [Farriter] in the [parish of Killeeshil,] County of Tyrone by Margaret Ferguson otherwise Huggins his wife of the one part and the Rev’d William Nixon of the City of Dublin Batchellor [sic] 4 of Arts of the other part

… whereby Reciting as therein is Recited the sai’d Jn’o Ferguson for the Consid’n [Consideration] therein Ment’d [mentioned] 5 Did Grant Bargain Sell Assign Alien Release and Confirm 6 unto the Said W’m Nixon the one half of the Said Jn’o Ferguson[‘]s Moiety of the S’d lands of Faratar Cont’g [Containing] Sixty Six Acres two Roods or thereabouts 7 Situate lying and Being in the Parish of Killishill [Killeeshil] Barony of Dungannon and County of Tyrone

… To hold to the S’d W’m Nixon his heirs and assigns 8 forever, Subject to the paym’t of the yearly Rent of three pounds

… which Said Deed is witnessed by Arthur Dunn, Gent. and Thomas Windell of the Said City Cutler 9 and this Mem’l is witnessed by the S’d Arthur Dunn and Cha’s M’c Nallow of the S’d City Gent’n.

  1. This memorial was registered on same date as that registered by John Ferguson the younger’s uncle and namesake, John Ferguson (the elder), who executed Memorial no. 212795 , a similar deed of assignment to the Rev. William Nixon. ↩︎
  2. An apostrophe indicates that the letters following were written in superscript in the original text. The affected words were contractions or abbreviations. ↩︎
  3. J’no is an abbreviation for the forename, John. ↩︎
  4. [sic], Latin, “thus” or “just as.” The conventional use implies sic erat scriptum, “thus it was written.” [sic] is an editing device used to communicate to the reader that the transcriber has duplicated the text meticulously as it was written, even if there appears to be an error in spelling, punctuation, syntax, grammar, fact, logic, &c.   5. The phrase, “for the consideration therein mentioned,” obscures the amount of money or other form of compensation exchanged.   6. Though the language, “grant, bargains, sell”, &c., suggests the sale of land, the right, title, and interest to the leasehold itself was the object of the sale. Under the 17th – 19th century system of land tenure in Ireland, a tenant did not possess the freehold or ownership in fee to the land he occupied, and he could not sell that land. Therefore, this transaction is more properly characterized as a conveyance or assignment of the leasehold. ↩︎
  7. It is not stated whether the acreage was stated in English statute, Irish (alias Plantation), or Scots (alias Cunningham) measure. However, the mention of roods suggests English statute measure . ↩︎
