A Memorial of Deeds of Lease & Release bearing date Respectively the Thirtieth and thirty first days of May in the year of our Lord one Thousand seven hundred & fifty five the Lease made Between Joseph Marshall the younger of Clerkeen 2 in the C’o of Tyrone Gent of the one part & John Hugins [Huggins] of Clenarb 3 & Cornelius Marshall of Calledon both in the said County of Tyrone Gent of the other part

… witnesseth that the said Joseph Marshall in Consideration of the sum of five Shillings to him in hand paid by the s’d John Hugins and Cornelius Marshall did grant Bargain & Sell unto the said John Hugins & Cornelius Marshall their Heirs & Assigns all that the Town & Lands of Clenkeen [Glenkeen] with the appurtenances thereto belonging Situate in the parish of Aghaloo B’o [Barony] of Dungannon & C’o of Tipperary [sic] afores’d

… To hold the same from the first day of May then Instant for the Term of one whole year from thence next Ensuing fully to be Compleat & Ended

… & by the s’d Deed of Release made Between the said Joseph Marshall the younger of the first p’t [part] y’e s’d Jn’o Hugins & Cornelius Marshall of the second part & Joseph Marshall the Elder of Dyan in y’e s’d C’o of Tyrone gent and Jane Marshall his Daughter of the third part

… Witnesseth that the said Joseph Marshall the younger for & in Consideration of a Marriage then Intended to be had & Solemnized by & between the s’d Joseph Marshall the youn’r & y’e s’d Jane Marshall & of the sum of Two hun’d [hundred] pounds Ster [Sterling] agreed to be paid to the said Joseph Marshall with the s’d Jane as a Marriage Portion he the said Joseph Marshall did grant Bargain & Sell unto the said Jn’o Huggins & Cornelius Marshall their Heirs & assigns all that and those the before recited town & Lands of Clenkeen with the appurtenances thereto belonging Situate in the said Parish of Aghaloo Barony of Dungannon & County of Tyrone aforesaid

… To hold the same unto them the said John Huggins [sic] and Cornelius Marshall their Heirs & Assigns for ever

… Subject nevertheless to the several Provisoes Limitations & Agreem’ts therein particularly mentioned & Expressed that is to say the said Towns & Lands of Clonkeen [sic] to go to the use benefitt & behoofe of the said Joseph Marshall the younger for the Term of his natural Life without Impachm’t [Impeachment] of waste  & after his death to the use of the Issue male Lawfully to be begotten by the said Joseph Marshall the younger on the Body of the said Jane Marshal [sic] his said Intended wife & in default of such Issue then to the use of the Issue Male Lawfully to be begotten by the said Joseph on the Body of the said Jane with this further Covenant & Condition that in Case the said Jane Marshall Shall happen to survive him the said Joseph Marshall her said Intended husband without Leaving any Issue by them lawfully begotten that then & in such case she shall have and Receive yearly & every year during her natural Life out of said Lands of Clonkeen the full & Intire Sum of Twenty Pounds a year & in Case the s’d Jo’s Marshall Shall have more than two Children living at the Time of his death then only the Sum of Twelve pounds a year during her natural Life as by the said Deeds of Lease and Release relation being thereto had may more at Large appear

… which s’d Deeds of Lease & Release were Executed by the parties thereto in the presence of Patrick Brally of Dyan in the County of Tyrone yeoman   John Hugins the young[er] of the same parish Gent   John Scott of Armagh in the C’o of Armagh Gent who are subscribing Witnesses thereto & this Memorial was Executed by the said Joseph Marshall in the presence of the said John Scott & Rob’t Young of Knockbane 4 in the said County of Armagh

… County of Armagh to witt at a General Quarter Sessions of the peace held at Lurgan in & for said County the seventeenth day of July 1755 __

… John Scott of Armagh in the County of Armagh Gent this day maketh oath before us that he is a Subscribing Witness to the Deeds of Lease & Release above mentioned and of which the above writing is a Memorial & saw the parties thereto duly Sign Seal and Execute the same & is also a Subscribing Witness to this Memorial and that he saw the above named Joseph Marshall duly Sign Seal and Execute the Same & Saith the name John Scott subscribed as a Witness to the said Deeds of Lease & Release & this Memorial is his this Dep’ts [Deponent’s] proper hand writing
