A Memorial of a Deed Poll made Between John Huggins [sen. or I] of Glenarb
in y’e Par’h [Parish] of Achelow [Aghaloo] B’o [Barony] of Dungannon & C’o of Tyrone & his son John [jun. or II] of the one p’t [part] & The Rev’d John Kennedy of Edenderry in y’e Par’h [of Eglish] & C’o of Armagh & Lettice Kennedy his sec’d [second] Daur [Daughter] of y’e other p’t bearing date the Thirty first day of Aug’st One thous’d seven hund’d & thirty nine
… Whereby in Consid’n [Consideration] of a Marriage therein Intimated shortly thereafter to be had & Solemnized between his s’d Son John Huggins & y’e s’d Lettice Kennedy, the s’d John Huggins Sen’r doth give & make over to his s’d son the Lease of that part of Glenarb he now Posseth [Possesseth] with all houses household Goods & Chattles as they are parly [particularly] ment’d [mentioned] in the s’d Deed only the parlars [particulars?] therein Excepted & reserved but otherwise free of all Rent Tyth & Serv’ts [Servants’] Wages to the first day of Nov’r next after the date of the s’d Deed
… & further the s’d Jo’n Huggins the father makes over to his s’d Son his Lease in Kedy [Kedew] at his Decease Except’g only & reserv’g [reserving] such p’t of the s’d Holding as is Possed [Possessed] by his Sons in Law Joseph Marshall & Dav’d Ferguson & his Daur Marg’t
… And also the s’d John Huggins the father makes over unto his s’d Son the Sum of Two hundred pounds Ster as a Debt due to him by M’rs Johnston of Nappock 1 & his s’d Son to receive the Int’t [Interest] but y’e Principal to be reserved for his wife & Children & no more or other p’t of the s’d Sum with’t [without] the Consent of his Father the s’d Jo’n Huggins & his fatherinlaw the s’d John Kennedy & further…

… the s’d John Kennedy doth Cov’t [Covenant] & Agree by the s’d Deed in Consid’n of y’e Leases & Money above granted & his nat’l [natural] Affection he bears to his said Daur Lettice to give the Just & full Sum of One hundred pounds Ster in the space of Twelve Months as a Marriage Portion w’h [whcih] his s’d Daur as by the s’d Deed referrence [sic] being thereunto had may more at large appear
… The Due Execution whereof by y’e s’d John Huggins Sen’r & John Huggins Jun’r is Witnessed by W’m Herdman & Ja’s Kennedy of Edenderry in y’e C’o of Armagh Gent & the Signing & Sealing of this Mem’l [Memorial] by the s’d John Huggins the Son Adm’r [Administrator] & residuary Legatee 2 of his father the s’d Jo’n Huggins the Elder is Witn’d [Witnessed] by the s’d W’m Herdman & And’w Carmichael of Dungannon in the C’o of Tyrone afores’d Gents

The abovenamed W’m Herdman came this day before me & made Oath that he saw the said John Huggins the Elder & Jo’n Huggins the younger duly Execute the above mentioned Deed whereof y’e above Writing is a Memorial in the psence of this Dep’t [Deponent] & that he likewise saw the said John Huggins the Younger Sign & Seal the above Written Mem’l [Memorial] & that the name W’m Herdman Subscr’d [Subscribed] as a Witness to the said Deed & Mem’l is this Dep’ts [Deponent’s] own proper handwriting

- Possibly Knappagh townland in the parish of Eglish, county Armagh. ↩︎
- John Huggins (I) died c.1741, and this memorial was registered in 1749. ↩︎
- Two notes about the dates appearing in this memorial, viz.:
– 31st Aug. 1739, on which date the parties executed a deed of marriage settlement;
– 4th Oct. 1749, when the memorial was sworn by a witness to both the deed and the memorial before a local Commissioner and Justices of the Peace; and,
– 7th Mar. 1749, when the memorial was registered at the Registry of Deeds in Dublin.
In the first instance, more than ten years had elapsed between the execution of the deed and the preparation & witnessing of the associated memorial. The reasons for this gap are unknown but, in the early days of the Registry, gaps like these were not uncommon.
In the second, at first glance it appears that the memorial was registered in Dublin before it was sworn to a local Commissioner. However, this was not so, and this apparent anomaly illustrates how the old-style Julian calendar worked. Under the Julian system, the first day of the year was 25th March. Because the Calendar (New Style) Act 1750en.wikipedia.org had not yet been passed, in this memorial the 7th March 1749 followed 4th October 1749. After the Act came into effect on 1st January 1752, dates in pre-1752 records which fell between January 1st and March 24th were often written in a compound format, for example, 1749/50. ↩︎
